1. Acceptance of Terms

By accessing our website and using our services, you agree to comply with and be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services or make any bookings.

2. Booking Terms

2.1 Booking Process

  • All bookings are subject to availability and confirmation
  • Bookings must be made through our official channels (website, phone, email)
  • You must provide accurate and complete information during booking
  • We reserve the right to refuse any booking at our discretion

2.2 Payment Terms

  • A non-refundable deposit of 30% is required to confirm your booking
  • Full payment must be made 15 days before the tour start date
  • For bookings made within 15 days of departure, full payment is required immediately
  • We accept various payment methods including credit/debit cards, bank transfers, and UPI

2.3 Price Changes

We reserve the right to change prices due to circumstances beyond our control, including but not limited to:

  • Changes in government taxes and fees
  • Fuel price fluctuations
  • Currency exchange rate changes
  • Force majeure events

3. Cancellation Policy

Cancellation Charges

All cancellation requests must be made in writing. The following cancellation charges apply:

30 days or more before departure 25% of total package cost
15-29 days before departure 50% of total package cost
7-14 days before departure 75% of total package cost
Less than 7 days before departure 100% of total package cost
No show 100% of total package cost
Special Notes:
  • Booking deposit is non-refundable under any circumstances
  • Refunds will be processed within 15 working days
  • Bank charges for refund processing will be borne by the customer

4. Tour Modifications & Changes

4.1 Changes by Customer

  • Name changes are permitted up to 15 days before departure with applicable fees
  • Tour date changes are subject to availability and may incur additional charges
  • Package downgrades are treated as cancellations and re-bookings

4.2 Changes by Bengal Holiday

We reserve the right to modify tour itineraries due to circumstances beyond our control:

  • Weather conditions and natural disasters
  • Political unrest or safety concerns
  • Transportation delays or cancellations
  • Government regulations or restrictions

In such cases, we will provide suitable alternatives or partial refunds as appropriate.

5. Customer Responsibilities

5.1 Travel Documents

  • Valid government-issued photo ID is mandatory for all travelers
  • Foreign nationals must carry valid passports and necessary visas
  • Permits for Sundarban Tiger Reserve will be arranged by us
  • Customers are responsible for ensuring document validity

5.2 Health & Safety

  • Inform us about any medical conditions or special requirements
  • Follow all safety instructions provided by guides and crew
  • Carry necessary medications and health insurance
  • Maintain adequate hydration and sun protection

5.3 Conduct

  • Respect local customs, traditions, and wildlife
  • Follow instructions of tour guides and boat crew
  • Avoid littering and maintain environmental cleanliness
  • No alcohol consumption during jungle safaris and boat rides

6. Liability & Insurance

6.1 Our Liability

Bengal Holiday acts as an agent for various service providers and shall not be liable for:

  • Loss, damage, or theft of personal belongings
  • Personal injury, illness, or accidents during the tour
  • Delays or cancellations due to circumstances beyond our control
  • Changes in itinerary due to weather or safety concerns

6.2 Travel Insurance

We strongly recommend that all travelers obtain comprehensive travel insurance covering:

  • Medical emergencies and evacuation
  • Trip cancellation and interruption
  • Lost baggage and personal effects
  • Personal accident and liability

7. Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to events beyond our reasonable control, including but not limited to:

  • Natural disasters (cyclones, floods, earthquakes)
  • Government actions, restrictions, or travel bans
  • Political unrest, strikes, or civil commotion
  • Epidemics, pandemics, or health emergencies
  • Transportation failures or accidents

In such cases, we will make reasonable efforts to provide alternative arrangements or partial refunds.

8. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Bengal Holiday and protected by copyright laws. You may not:

  • Reproduce, distribute, or modify any content without permission
  • Use our branding or trademarks without authorization
  • Scrape or collect data from our website
  • Use our content for commercial purposes

10. Governing Law & Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Kolkata, West Bengal.
